The present terms and conditions of sale are entered into by SAS IE2C with capital of €10,000, whose registered office is at 155 avenue du Dirigeable, 13400 Aubagne, registered in the MARSEILLE trade register under number 793 169 947, and by any individual or legal entity wishing to make a purchase via the https://www.exalto-professional-shop.com/gb/ website.
Anyone visiting the site can read the General Terms and Conditions of Sale on the https://www.exalto-professional-shop.com/fr/ website. These General Terms and Conditions of Sale may be modified from time to time. The conditions applicable are those in force on the site at the date your order is placed.
1. Contract and acceptance of condition
The purpose of these terms and conditions of sale is to define the contractual relationship between SAS IE2C and the buyer, and the conditions applicable to all purchases made through the https://www.exalto-professional-shop.com/gb/ merchant site, whether the buyer is a professional or a private individual.
2. Order
To place an order, the purchaser must follow the instructions on the site. The order is first summarized, listing all the products selected by the purchaser. The buyer then validates the order. At this point, you declare that you accept the present General Terms and Conditions of Sale in full and without reservation. The data recorded by SAS IE2C constitutes proof of all transactions between SAS IE2C and its customers and only this data is authentic in the event of a dispute between SAS IE2C and its customer.
IE2C then confirms that the order has been taken into account by sending an automatic e-mail. The transfer of ownership of products sold on the https://www.exalto-professional-shop.com/gb/ website takes place upon full payment of the order. IE2C reserves the right to cancel any order from a customer it deems to be financially insolvent, or from a customer with whom there is a dispute concerning payment of a previous order. The information provided by the purchaser when placing an order is binding: in the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.
To place an order for products on our site, the customer must first request to open a customer account with IE2C, unless he/she already has a customer account on the day of the first order. The buyer undertakes to provide true and sincere information and to inform IE2C of any changes concerning them. Once the account has been opened, to log in, the purchaser must enter both an e-mail address and a password, both of which are strictly confidential.
Return procedure for malleable heads
If the product received does not meet your expectations, you must return it to us at your expense within a maximum of 14 days. As soon as we receive it, we'll carry out an assessment within a maximum of 15 days. This will enable us to provide you with an appropriate response.
If the product has been used (products applied, cut, color, etc.), we cannot issue a refund. Once the product has been used, SAS IE2C can no longer guarantee the product or its quality, as it is impossible to determine whether the problem stems from its initial quality or from the customer's use.
If the product is found to have been misused, we will not be able to provide you with an exchange or refund.
3. Products and stock
The photographs illustrating the products are not contractually binding. IE2C cannot be held responsible for any errors that may have been made. The seller reserves the right to make any changes it deems necessary to its products at any time, and to modify the models available on the https://www.exalto-professional-shop.com/gb/ website without prior notice.
4. Terms of payment
The price invoiced to the customer is the price indicated on the order confirmation sent by SAS IE2C. The transfer of ownership of products sold on the https://www.exalto-professional-shop.com/fr/ website takes place upon full payment of the order. As long as the items have not been paid in full by the customer, they remain the property of SAS IE2C.
SAS IE2C reserves the right to modify its prices without prior notice.
Payment for purchases can be made using several methods of payment (Payplug (credit card), Paypal). Payment by credit card will be debited from the total amount of the order immediately after validation on the website. For card payments, only CB, Visa, Mastercard, Amex, Apple Pay, Bancontact are accepted.
Online payments are secured by the 3D Secure system. SAS IE2C uses the Payplug & Paypal secure payment systems. The order validated by the customer will not be considered effective until Payplug or Paypal has given its approval. In the event of refusal, the order will be automatically cancelled and the customer notified by e-mail. In addition, IE2C reserves the right to refuse any order from a customer with whom a dispute exists.
Payment by cheque or bank transfer is not accepted.
5. Terms of delivery
Delivery within the European Union will be made by GLS or UPS according to your choice. You will find below the list of countries that can only be delivered by UPS: list.
Delays do not entitle the buyer to claim damages.
For countries outside the European Union, customs fees will be charged by UPS upon arrival of your package. Without payment of these charges, the parcel cannot be delivered. SAS IE2C will not be held responsible for this situation and no refund will be made if the customer does not pay the customs fees within the allotted time. SAS IE2C has no knowledge of the amount of customs charges applied upon arrival of your package(s).
Delivery time in France is 2 to 3 working days after order validation. To find out your delivery time (outside France), please refer to the "Delivery cost guide" table on your product page. Orders placed after 1pm cannot be dispatched the same day. The order will be dispatched on the next working day.
Delivery is free for European Union countries for orders over €220 incl. VAT.
In the case of relay point delivery, the maximum unit weight is 30 kg. The day the parcel arrives at the point Relais, the recipient is notified by e-mail. The parcel remains pending at the point Relais for eight days from the day following its arrival. If it is not received by the recipient within this period, it is automatically returned to the sender. For a new delivery of the goods, the buyer will have to pay a new delivery cost. In addition to the parcel number, the recipient will be asked to show proof of identity when collecting the parcel from the Relay Point. If the parcel is collected by a third party not mentioned on the transport document, he/she must present a valid power of attorney, the recipient's identity document (or the recipient's Kbis if the recipient is a legal entity) and his/her own identity document.
All our shipments are made at the risk and peril of the consignee, who must exercise all possible recourse against the carriers. In the event of partial loss or non-receipt of the parcel despite proof of delivery from the carrier, the recipient must note the loss and/or damage when the parcel is handed over, specifying clear, significant, complete, dated and signed reservations. Claims must be sent to us by e-mail no later than 48 hours after the delivery date. They must contain the following information: the customer's name (and order reference), the parcel number, the purchase invoice excluding VAT corresponding to the goods contained in the parcel in question, a sworn statement of non-insurance, a statement of non-possession in the event of loss or delivery error or signature dispute.
Failing this, even in the presence of reservations formulated on the delivery note, our responsibility cannot, under any circumstances, go beyond the replacement or reimbursement of the materials or goods, object of the defective delivery.
6. Satisfied or your money back (right of withdrawal)
All products sold on the www.exalto-professionnel.fr website benefit from the "satisfied or reimbursed" clause for 14 days from the date of delivery, in accordance with article L121-20 of the French Consumer Code.

This right of withdrawal cannot be exercised if the products delivered have clearly been used for a long time (more than a few minutes). Products must be returned in their original packaging, correctly protected, in perfect condition for resale (not damaged or soiled by the customer) and accompanied by any accessories.
Packages will not be accepted if there is no way to identify the sender (surname, first name, address, order number). The return of all products or services ordered will give rise to a refund equal to the total amount paid by the customer.
The refund will be made to the customer's bank within 30 days of receipt of the returned goods.

Your order will be accepted while stocks last. Each article presented on the site is normally available in our stocks.
For orders from abroad, if you have a valid VAT number, you can benefit from tax-free prices. You can indicate your VAT number when registering your account.
SAS IE2C reserves the right to modify its prices at any time, but products will be invoiced on the basis of the rates in effect at the time orders are registered, subject to availability on that date.
8. Disputes
This contract is governed by French law, regardless of the nationality of the purchaser. IE2C cannot be held responsible for any damage of any kind, whether material, immaterial or physical, which may result from the malfunction or misuse of the products marketed.
Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situation. In the event of a dispute, the customer should first contact the company for an amicable solution.
Failing this, the Marseille Commercial Court shall have sole jurisdiction, irrespective of the place of delivery and method of payment accepted.
9. Legal information or intellectual property
SAS IE2C undertakes not to divulge to third parties any information that you may communicate to us. This information is confidential. It will only be used by its internal services to process your order.
The www.exalto-professionnel.fr website is the property of IE2C in its entirety, as are all related rights. Any reproduction, in whole or in part, is subject to the authorization of the owners.
10. Your account
Your account is personal to you and you may not share your login credentials with any third party or allow any third party access to your account. As you will be responsible for all activities that occur under your login details, you must keep your username and password secret. If you have reason to believe that your account information has been compromised or that a third party has accessed your account, you agree to immediately notify Exalto Professionnel by e-mail at amandine@exalto-professionnel.fr.
